Misdemeanor and Felony Theft

Michigan Misdemeanor Offenses consist of:

 

Petty Theft or Larceny of goods or services valued at less than $200

Punishable up to 93 days in jail and a fine not more than $500 or (3x) the value of stolen items.

Petty Theft or Larceny (second degree) of goods or services valued between $200 and $1000.

Punishable up to one year in jail and a fine up to $1000 or (3x) the value of stolen items.

Michigan Felony Offenses consist of:

Felony Theft of goods or services valued between $1000 and $20,000.

Punishable up to 5 years in prison and a fine up to $10,000 or (3x) the value of stolen items.

(Felony theft applies to vehicles, trailers or any motor vehicle part, even if not valued at more than $1000) 

Felony Theft (second degree) of goods or services valued at $20,000 or more

Punishable up to 10 years in prison and a $15,000 fine or (3x) the value of stolen items.

Prior Theft Convictions Can Lead to Higher Charges

Anyone convicted of a prior theft offense could face a second conviction that carries penalties one degree higher than the charged offense.

Example – if goods or services were stolen valued under $200, but the defendant has a prior conviction, they could very well face penalties at the next level between $200 and $1000.
