We recommend not drinking alcohol following an accident at least until the accident investigation has been completed.  We’ve represented a client who backed his snowplow into the rear of a school bus and kept pushing against the school bus for at least a full minute as the frightened school bus driver set her parking brake to avoid being pushed into traffic.  The incident, some caught on a witness’ cell-phone video, concluded with our client rapidly driving away from the school bus without discussing the collision with the bus driver.  Approximately 40 minutes after the collision, our client was found at his home by two Muskegon County Sheriff’s Deputies who testified at trial that our client was drunk and confrontational.  A blood draw following arrest revealed a blood alcohol level of .15, nearly twice the legal limit for driving.   Originally charged with Assault with a Dangerous Weapon, our client was ultimately tried before a jury for OWI, reckless driving and failure to report an accident.

A narrow view of the facts focuses directly on the strange driving and the accident and of course the evidence of serious alcohol consumption.  We were able to prove the rest of the story.  A faulty gear mechanism caused the strange driving, and the client’s heavy consumption of alcohol after the collision, not before, explained his behavior when confronted by Sheriff’s Deputies and his .15 blood alcohol level.  The case concluded when the jury found our client “not guilty” of the two driving offenses and found him guilty of failing to report the accident for which our client paid a fine.  In the event you find yourself charged with a criminal offense, we will strive to make certain the whole story is heard.
